Terms of service

These Terms of Service (“Terms”) govern your access to and use of the Aptly website, applications and services (together, the “Service”). The Service is operated by NexGen Concepts Pte Ltd, a company incorporated in Singapore with its registered address at 11 Keng Cheow Street, Riverside Piazza, Singapore (“Aptly”, “we”, “us”, “our”).

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Aptly is a marketplace that helps parents and students in Singapore discover and connect with private tutors. We provide discovery, matching, messaging, reviews and reputation tools. We are not a tuition agency, an employment agency, or an employer of tutors, and we are not a party to any tutoring arrangement made through the Service. Lessons, schedules, fees and lesson payments are arranged and settled directly between users.

You must be at least 18 years old to create an account. Students under 18 may use the Service only through, and under the supervision of, a parent or legal guardian who accepts these Terms on their behalf. You agree to provide accurate, current information, to verify your email address and mobile number, and to keep your details up to date.

You are responsible for all activity under your account and for keeping your credentials secure. One person may hold one account. Notify us immediately at [email protected] if you suspect unauthorised use of your account.

You agree not to:

• impersonate any person or misrepresent your identity, qualifications or affiliation;
• post false, misleading or unlawful content, or content that infringes another's rights;
• harass, threaten, defraud or discriminate against other users;
• solicit or share contact details, or move a conversation off-platform, before a booking is confirmed;
• scrape, copy, or build a competing dataset from the Service, or circumvent its security or rate limits;
• use the Service for any purpose that breaches applicable Singapore law.

Sharing contact details in messages before a confirmed booking is restricted and enforced by an automated three-strike system that may suspend messaging or the account.

Reviews may only be left within a genuine tutoring relationship and must be honest and based on first-hand experience. We may remove reviews that breach these Terms and may adjust or withhold an Aptly Score™ where integrity is in doubt. Reviews can be challenged through the in-app dispute process. You grant us the right to display, aggregate and surface your reviews and reputation metrics as part of the Service.

Aptly Pro is an optional paid subscription for tutors, billed through our payment processor, Stripe. It renews automatically for successive periods until cancelled and may be cancelled at any time from your settings; access continues until the end of the current paid period. Fees are stated at checkout and are inclusive of GST where applicable. Except where required by law, payments are non-refundable for periods already started. Founding Tutor pricing, where offered, applies for the life of a continuous subscription. We may change subscription pricing or features on reasonable notice; changes take effect at your next renewal. Pro features never alter your reviews or Aptly Score.

Aptly does not verify MOE employment status, set lesson terms, supervise lessons, or guarantee any educational or other outcome. Tutors are solely responsible for their conduct, the accuracy of their profiles, their tax and regulatory obligations, and compliance with applicable rules — including Ministry of Education (MOE) guidelines on private tuition by serving teachers. Parents and students are responsible for independently vetting and supervising any tutor they engage.

The Service, including its software, design, trade marks and content (excluding user content), is owned by or licensed to NexGen Concepts Pte Ltd and is protected by law. You retain ownership of the content you submit, but grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content as needed to operate, promote and improve the Service. You are responsible for ensuring you have the rights to the content you submit.

The Service relies on third-party providers (for example Stripe for payments, and email/SMS delivery and cloud hosting providers). Your use of those features may be subject to the provider's own terms. We are not responsible for third-party services we do not control.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that any tutor, parent or student is suitable for your needs.

To the maximum extent permitted by law, NexGen Concepts Pte Ltd and its officers, employees and agents will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, goodwill or data, arising from your use of the Service or any tutoring arrangement. Our total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the fees you paid to us in the 12 months before the event giving rise to the claim, or (b) SGD 100. Nothing in these Terms excludes liability that cannot be excluded under Singapore law.

You agree to indemnify and hold harmless NexGen Concepts Pte Ltd from any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your tutoring arrangements with other users.

We may suspend or terminate your access if you breach these Terms or to protect the Service or its users. You may close your account at any time from settings. Sections that by their nature should survive termination (including intellectual property, disclaimers, liability and indemnity) will survive.

We may update these Terms from time to time. We will update the “Last updated” date above and, for material changes, provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Singapore. You and NexGen Concepts Pte Ltd submit to the exclusive jurisdiction of the courts of Singapore, without prejudice to any mandatory consumer protections available to you under Singapore law.
